Agreement to Terms
By accessing or using the Denximoza website (denximoza.com) or engaging our construction inspection services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
Services Description
Denximoza provides independent construction inspection services for collective investment projects, housing cooperatives, and organized groups in Chile. Our services include:
- On-site construction progress verification
- Quality assessment of construction work
- Photographic documentation
- Written inspection reports
Our inspections are observational in nature and do not constitute engineering analysis, structural certification, or building code compliance verification.
Service Limitations
Our inspection services have the following limitations:
- We provide observations based on visual inspection at a specific point in time
- We do not perform destructive testing or invasive investigation
- We do not provide engineering calculations or structural analysis
- We do not certify code compliance or issue building permits
- Our reports reflect conditions visible at the time of inspection
Independence and Objectivity
Denximoza maintains independence from both construction companies and investor groups. While clients engage and compensate us for services, we do not advocate for any party's position. Our reports document observed conditions without bias toward any stakeholder.
Client Responsibilities
Clients engaging our services agree to:
- Provide accurate information about the construction project
- Arrange appropriate site access for inspections
- Provide relevant project documentation when requested
- Use inspection reports for their intended informational purpose
- Not misrepresent or alter inspection findings
Report Usage and Distribution
Inspection reports are prepared for the client who engaged our services. Clients may share reports with relevant stakeholders in their project but may not:
- Alter, modify, or edit report content
- Remove attribution to Denximoza
- Use reports for purposes beyond the specific project inspected
- Publicly distribute reports without our consent
Liability Limitations
To the maximum extent permitted by Chilean law:
- Denximoza's liability is limited to the fees paid for the specific inspection service
- We are not liable for construction defects, delays, or financial losses
- We are not responsible for decisions made based on inspection reports
- We do not guarantee that all defects or issues will be identified
Our inspection services provide information to assist decision-making but do not eliminate risk inherent in construction projects.
Intellectual Property
All content on the Denximoza website, including text, graphics, logos, and images, is the property of Denximoza and protected by Chilean and international copyright laws. Inspection reports prepared for clients remain our intellectual property, though clients receive a license to use them for their project purposes.
Payment Terms
Payment terms for inspection services are established in individual service agreements. Generally:
- Payment is due within 30 days of invoice date
- Inspection reports are delivered upon payment confirmation
- Late payments may incur interest charges as permitted by law
Cancellation and Rescheduling
Clients may cancel or reschedule inspections with appropriate notice:
- Cancellations with 48 hours notice: no charge
- Cancellations with less than 48 hours notice: 50% of inspection fee
- Cancellations with less than 24 hours notice: full inspection fee
Confidentiality
We maintain confidentiality regarding project details and client information, except as required by law or with client consent. We do not disclose inspection findings to parties other than the client who engaged our services.
Website Use
When using our website, you agree to:
- Provide accurate information in contact forms
- Not attempt to gain unauthorized access to our systems
- Not use the website for any unlawful purpose
- Not transmit harmful code or malware
Third-Party Links
Our website may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of service of external sites.
Dispute Resolution
Any disputes arising from these Terms of Service or our inspection services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the jurisdiction of Chilean courts in La Serena, Coquimbo Region.
Governing Law
These Terms of Service are governed by the laws of Chile. Any legal proceedings shall be conducted in Spanish unless otherwise agreed.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes become effective upon posting to our website. Continued use of our services after changes constitutes acceptance of modified terms.
Severability
If any provision of these Terms of Service is found to be unenforceable, the remaining provisions shall continue in full force and effect.
